UPDATE: Mobility of passengers - Bus and Coach
The European Parliament’s Transport committee has strengthened the proposal for a regulation aimed at protecting the rights of bus and coach passengers. The proposal presented by the European commission in November 2008 introduces compensation for cancelled or significant delayed journeys, as well as providing special assistance for people with reduced mobility.
In adopting the report by Gabriele Albertini (EPP-ED Italy), the committee changed the original proposal to bring it more in line with what exists for compensation in the railway sector. It suggests that passengers have a right to compensation of the equivalent 50% of the ticket price if the service is cancelled or delayed by more than two hours, and that for long delays bus and coach companies are obliged to offer meals, refreshments and a night’s stay in a hotel if necessary.
The proposal also sets downs rules for company liability in case of passenger’s injury or death as a result of an accident and for loss or damage to luggage. It establishes an advance payment mechanism for compensation for injury or death, in proportion to the damage done. MEP’s clarified that in case of death this advance could not be less than 21,000 euro. However, an amendment to the text stipulates that companies are not bound to pay if the accident was caused by external circumstances that the operator could not avoid. This will lead to future legal disputes in case the transport operator refuses liability in a given situation using “external circumstances” as an excuse. Furthermore, MEPs also gave members states the right to exclude bus or coach transportation in urban, suburban and regional areas from the scope of the regulation alleging the specific characteristics (no advance reservation, the use of daily, weekly monthly and annual tickets, numerous stops).
